These Terms of Service govern access to and use of seapm.shop and all purchases made through the website.
Please read these Terms carefully before using the website or submitting an order. Mandatory consumer rights under German and European Union law remain unaffected.

2. Scope
These Terms apply to contracts concluded through seapm.shop between the seller and its customers.
A “consumer” is a natural person entering into a transaction primarily for purposes outside their trade, business, or profession.
A “business customer” is a natural or legal person or partnership acting in the exercise of a trade, business, or professional activity.
Where different provisions apply to consumers and business customers, this will be stated in the relevant section.
3. Website Use
You may use this website only for lawful purposes.
You must not:

Use a payment method without authorisation

Attempt to access another customer’s account

Introduce viruses, malware, malicious code, or automated attacks

4. Customer Accounts
Customers may be able to purchase as guests or through a registered customer account.
You are responsible for:

Preventing unauthorised access to your account

Informing us promptly of suspected unauthorised activity
You are not responsible for unauthorised account activity that occurred without your fault.
We will never ask you to disclose your complete password by email.
5. Product Information
We make reasonable efforts to describe and display products accurately.
The characteristics, specifications, compatibility information, included accessories, intended use, and technical requirements displayed on the relevant product page form part of the product description.
Product images may appear slightly different because of screen settings, lighting, production batches, or minor technical changes that do not materially affect the agreed characteristics or normal use of the product.
Where exact dimensions, voltage, power requirements, compatibility, certification, or technical specifications are important, customers should review the complete product description before ordering.
We will not substitute a materially different product without the customer’s express agreement.
6. Product Availability
Products are offered subject to availability.
Placing a product in a shopping cart does not reserve it.
If a product becomes unavailable after an order is submitted, we will notify the customer without undue delay. Any payment received for an unavailable product will be refunded using the original payment method.
7. Contract Formation
Product listings constitute an invitation to submit an order and are not, by themselves, a binding offer.
By clicking the final checkout button indicating an obligation to pay, the customer submits a binding offer to purchase the products in the order.
Before submitting the order, the customer can review and correct:

Payment details
After submission, the customer will normally receive an automated order acknowledgement. This confirms receipt of the order but does not necessarily constitute acceptance unless expressly stated.
The purchase contract is concluded when we:

Otherwise expressly accept the order,
whichever occurs first.
We may reject an order for legitimate reasons, including:

If an order is rejected after payment has been received, the payment will be refunded without undue delay.
8. Contract Language and Confirmation
The contract may be concluded in the languages made available during checkout.
Customers can save or print these Terms before ordering.
After placing an order, customers will receive confirmation in a durable format, normally by email. Order information may also be accessible through the customer account where an account was created.
9. Prices and Taxes
Unless otherwise stated, prices displayed to consumers are in euros and include applicable value-added tax.
The final price, including applicable taxes and delivery costs, will be displayed before the customer submits the order.
Customers will not be charged mandatory additional costs that were not clearly disclosed before purchase.
Obvious pricing errors are not binding. If an obvious error affects an order, we will contact the customer and offer the choice of confirming the order at the correct price or cancelling it for a full refund.
10. Payment
Available payment methods are displayed during checkout.
Payment processing may be provided by independent payment service providers. Their separate terms and privacy information may apply to payment processing.
By submitting payment details, the customer confirms that:

Sufficient funds or credit are available
We may conduct legally permitted payment verification and fraud-prevention checks.
We will not charge payment-method fees exceeding the amount legally permitted.
11. Delivery
We offer free standard delivery throughout Germany, unless a product page or checkout page expressly states otherwise.
The estimated delivery time is normally 5-14 business days after order processing.
Delivery estimates are not guaranteed delivery dates unless expressly agreed as binding.
Delivery will be made to the address supplied during checkout. Customers are responsible for checking the address before submitting an order.
Please contact us immediately if an address error is discovered. Address changes cannot be guaranteed after an order has been dispatched.
If delivery is delayed, mandatory consumer rights remain unaffected. Where required by law, consumers may set an appropriate additional delivery period and cancel the contract if delivery still does not occur.
12. Transfer of Risk
For consumers, the risk of accidental loss or damage generally transfers when the consumer or a third party designated by the consumer, other than the carrier, receives the goods.
Different rules may apply if the consumer independently appoints a carrier that was not offered or identified by us.
For business customers, the legally applicable commercial shipment rules apply.
13. Retention of Title
Products remain the property of ALBA Europe Holding Verwaltungs Public Limited Company until the purchase price has been paid in full.
The customer may not pledge, resell, materially alter, or otherwise dispose of unpaid products in a manner that interferes with our ownership rights.
14. Right of Withdrawal
Consumers purchasing products online generally have a statutory right to withdraw from the purchase contract within 14 days without giving a reason.
The withdrawal period normally begins when the consumer, or a third party designated by the consumer other than the carrier, receives the goods.

Nothing in these Terms limits a consumer’s statutory right of withdrawal.
The statutory right of withdrawal generally does not apply to business customers.
15. Returns and Refunds
Returns and refunds are governed by our Return and Refund Policy and mandatory law.
If there is a conflict between the Return and Refund Policy and mandatory consumer law, mandatory consumer law prevails.
Products are not excluded from mandatory withdrawal or defect rights merely because they were discounted or included in a promotion.
16. Legal Guarantee and Defective Products
Consumers benefit from the applicable statutory legal guarantee.
A product may be defective where it:

Does not match its description

Is unsuitable for its normal intended use

Is unsuitable for a particular purpose accepted by us

Does not include the agreed accessories or instructions

Does not have the quality, functionality, durability, compatibility, or safety reasonably expected

Was installed incorrectly because the supplied instructions were defective
Consumers may initially be entitled to repair or replacement free of charge.
Where repair or replacement is impossible, disproportionate, unsuccessful, delayed beyond a reasonable period, or causes significant inconvenience, consumers may be entitled to a price reduction or termination of the contract and a refund.
The statutory legal guarantee is normally at least two years from delivery for new consumer goods.
Damage caused solely by misuse, accidents, unauthorised modifications, improper maintenance, normal wear and tear, or use outside the specified operating conditions may not constitute a product defect.
17. Commercial and Manufacturer Warranties
A commercial or manufacturer warranty applies only if expressly offered for the relevant product.
Any commercial warranty is additional to the statutory legal guarantee and does not replace, restrict, or reduce statutory rights against the seller.
Warranty duration, coverage, territorial limitations, and claim procedures will be provided separately where applicable.
18. Product Safety and Proper Use
Products must be used only for their intended purpose and in accordance with:

Customers must not operate equipment unless they understand the instructions and can operate it safely.
This section does not limit our responsibility for product safety, conformity, defective instructions, or other non-excludable legal obligations.
19. Installation and Compatibility
Unless installation is expressly included in the order, customers are responsible for arranging proper installation by a suitably qualified person where professional installation is required.
Before ordering, customers should verify:

You grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce, and format submitted content for operating and promoting the store, subject to applicable privacy and personality rights.
We may moderate or remove content for legitimate reasons. We will not present paid or incentivised reviews as independent customer reviews.
22. Third-Party Services and Links
The website may use or link to services operated by payment providers, shipping companies, analytics providers, and other third parties.
We are not responsible for independent third-party websites that we do not control.
Third-party services may be governed by separate terms and privacy notices. This does not limit our legal responsibility for third parties used to perform our contractual obligations.
23. Shopify
The store is hosted using Shopify’s e-commerce platform.
Shopify provides technical infrastructure that enables us to display products and process orders.
The purchase contract is with ALBA Europe Holding Verwaltungs Public Limited Company, not Shopify, unless expressly stated otherwise.
24. Privacy and Communications
Personal data is processed in accordance with our Privacy Policy and applicable data-protection law.
We may send transactional communications necessary to process or perform the contract, including:

Customer-service responses
Marketing messages will only be sent where there is a valid legal basis. Customers may unsubscribe from marketing communications at any time.
25. Liability
We have unlimited liability where required by law, including liability for:

For damage caused by slight negligence, we are liable where an essential contractual obligation has been breached. In such cases, liability is limited to the foreseeable damage typical for the contract, to the extent permitted by law.
An essential contractual obligation is one whose performance is necessary for proper fulfilment of the contract and on which the customer may normally rely.
These limitations also apply to our directors, legal representatives, employees, and agents.
Nothing in these Terms excludes mandatory consumer remedies for defective or non-conforming goods.
26. Events Beyond Reasonable Control
We are not responsible for delays caused by events beyond our reasonable control, including:

Severe weather

Natural disasters

Transport interruptions

Strikes

Government measures

Infrastructure failures

Similar unavoidable events
We will take reasonable steps to minimise the effects and inform affected customers where appropriate.
Mandatory rights concerning delayed or failed delivery remain unaffected.

We will review complaints and respond within a reasonable period.
28. Consumer Dispute Resolution
Unless legally required in an individual case, we are neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board.
Consumers remain free to pursue their rights through the competent courts and other legally available procedures.
29. Governing Law
These Terms and contracts concluded through the website are governed by the laws of the Federal Republic of Germany.
The United Nations Convention on Contracts for the International Sale of Goods is excluded.
For consumers, this choice of law does not remove mandatory protections granted by the law of the country in which the consumer has their habitual residence.
30. Jurisdiction
Consumers may bring legal proceedings before any court with jurisdiction under applicable law.
If the customer is a merchant, a legal entity under public law, or a special fund under public law, the courts at our registered German branch office in Berlin will have jurisdiction to the extent legally permitted.
31. Changes to These Terms
We may update these Terms for future transactions where necessary because of legal, regulatory, technical, security, or operational developments.
The version applicable when an order is placed will continue to govern that order.
Changes will not retroactively alter an existing contract without the customer’s agreement or another valid legal basis.
The current version will be published on this page together with the date of the latest update.
32. Severability
If a provision of these Terms is invalid or unenforceable, the remaining provisions remain effective to the extent legally possible.
The invalid provision will be replaced by the applicable statutory rule.
This section does not restrict any mandatory protection granted to consumers.
